By downloading, installing, accessing, or using the Edly mobile application ("App") on iOS or Android devices, you agree to be bound by these Terms and Conditions ("Terms").

Edly is a mobile application available on iOS (App Store) and Android (Google Play Store) platforms that provides AI-powered educational services, including automated question paper generation, assessment tools, and educational content for students and educators. The App uses artificial intelligence to create customised learning materials and evaluations.

3. Eligibility and Child Protection (UK Compliance)

3.1 Age Requirements

• Users must be at least 13 years old to create an account independently
• Children under 13 may use the App only with explicit parental consent and supervision
• Users between 13-18 years old require parental or guardian consent before using the App

• Your use of the App on iOS devices is also governed by Apple's App Store Terms of Service
• Apple is not responsible for the App or any claims relating to it
• Apple has no obligation to provide maintenance or support for the App

5.2 Google Play Store

• Your use of the App on Android devices is also governed by Google Play's Terms of Service
• Google is not responsible for the App or any claims relating to it

6. User Conduct and Prohibited Uses

By agreeing to the terms and conditions, you are also agreeing not to:

• Use the App for any unlawful purpose or in violation of any laws
• Impersonate any person or entity or misrepresent your affiliation
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorised access to the App or its systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Use automated systems to access the App without permission

7. AI-Generated Content and Educational Material

7.1 AI Question Paper Generation

• The App uses artificial intelligence to generate educational questions, assessments, and learning materials
• AI-generated content is created based on curriculum standards and educational best practices
• While we strive for accuracy, AI-generated content may contain errors and should be reviewed by qualified educators
• Users are responsible for verifying the accuracy and appropriateness of AI-generated content before use

7.2 Content Accuracy and Limitations

• AI-generated questions and answers are provided for educational purposes only
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content
• AI-generated content should not be the sole basis for educational assessment without human review
• Users should cross-reference AI-generated content with authoritative educational sources

7.3 Intellectual Property in AI Content

• AI-generated content remains subject to our intellectual property rights
• Users may use AI-generated content for personal educational purposes
• Commercial use of AI-generated content requires separate licensing agreement
• Users may not claim ownership of AI-generated content or redistribute it without permission

7.4 Content Moderation and Safety

8. Child Safety and Restrictions (UK Specific)

• Children are prohibited from sharing personal information through the App
• There are no direct messaging or communication features available for users under the age of 18
• All user-generated content is moderated before publication

8.2 Screen Time and Usage Restrictions

8.4 Prohibited Content for Minors

Children are specifically prohibited from:

• Using the App for non-educational social interaction

8.5 Reporting and Safety Measures

• Clear reporting mechanisms are in place for inappropriate content or behaviour
• Immediate response protocols are in place for child safety concerns
• Regular safety audits and risk assessments are undertaken
• We cooperate with UK authorities regarding child protection matters

9. In-App Purchases and Subscriptions

9.1 Payment Terms

• All purchases are processed through the App Store (iOS) or Google Play Store (Android)
• Published prices may be subject to change
• All sales are final unless otherwise required by law

9.2 Subscriptions

• Subscriptions are automatically renewed unless cancelled
• You can cancel subscriptions through your device's account settings

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

14. Indemnification

You agree to indemnify and hold harmless Edly from any claims, damages, losses, or expenses arising from your use of the App or violation of the Terms and Conditions.

15. Termination

15.1 By You

You can stop using the App and delete it from your device at any time.

15.2 By Us

We may suspend or terminate your access to the App at any time, with or without cause, including for violation of these Terms and Conditions.

16. Geographic Restrictions

The App may not be available in all countries or regions. You are responsible for compliance with local laws regarding the usage of the app.

17. Changes to Terms

We reserve the right to modify the Terms and Conditions at any time. We will notify users of material changes through the App or other reasonable means. Continued use after changes constitutes acceptance of the new Terms and Conditions.

18. Governing Law and Dispute Resolution (UK Jurisdiction)

18.1 Governing Law

The Terms and Conditions are governed by the laws of England and Wales. For users in Scotland, Scottish law applies where different from English law. For users in Northern Ireland, Northern Ireland law applies where different from English law.

• Educational content complies with UK National Curriculum standards where applicable
